Court overturns appeals against Gov’t expropriations of Nam Vam and ‘Oceanis Park’ land plots

The Court of Final Instance (TUI) announced today (Tuesday) to have sustained Chief Executive orders to reclaim five land plots previously connected to the Fecho da Praia Grande project near Nam Vam Lake and for the Oceanis Park project land plot in Taipa.

In total the five land plots near Nam Vam Lake totalled 12,215 square meters and were previously handed by Sociedade de Empreendimentos Nam Van, S.A./Nam Van Development Company Ltd. to different companies.

The five land plots in question were held Sociedade de Investimento Imobiliário Chui Keng Van, S.A., Sociedade de Investimento Imobiliário Pun Keng Van, S.A., Sociedade de Investimento Imobiliário Tim Keng Van, S.A. with the respective land concessions declared as expired by the CE in May 2018 and leading to several appeals by the respective companies that were now overturned.

The top court also shot down an appeal by the appeal by Sociedade Chong Va – Entretenimento, Limitada, the previous owner of the 134,891 square meters land plot in Taipa in front of Regency Hotel.

The area was once projected to be used for the development of water theme park known as Oceanis Park, with the land lease expiring in 2001 and with the CE declaring it as invalid in 2018 for lack of development.

Chong Va includes in its management the current CEO of SJM Holdings, Ambrose So, and former legislator Fong Chi Keong.

According to the Urban Master Plan draft proposed by the Macau government and currently under public consultation, the respective area in Taipa is proposed to be used for commercial purposes.

Meanwhile, authorities have previously indicated that the land plots reclaimed near Nam Vam Lake – known as Zone C and D – will be used to build government and administration buildings.

The Urban Master Plan also proposes a building height clearance of around 62.7 meters in that area, for developments in the land plots B, C and D, along the coast from the Macau Tower to MGM Macau.

The top court decision now opens the way for the developments projected by the Macau SAR government to go forward.
