Secretary for Justice granted powers to amend judicial agreement with Chinese courts

The Macau Chief Executive has granted Secretary for Administration and Justice André Cheong Weng Chon the authority to sign with a representative of China’s Supreme People’s Court changes to the agreement on mutual requests for judicial procedures notifications and presentation of evidence in civil and commercial matters between Mainland and Macau courts.

The announcement, made today in a release at the Official Gazette, refers to an agreement signed between the Mainland and Macau in 2001 by the then Chief Executive Edmund Ho, which allowed the China’s Supreme People’s Court and the Macau Court of Final Appeal allowed to directly and reciprocally request the notification of judicial actions or the presentation of evidence.

Compliance with the request may be refused when the due diligence is outside the jurisdiction of the court or if compliance would breach the fundamental principles of law or public order of the Macau SAR.
